1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Offline Player concerning your access to and use of the Offline Player mobile application (the "Service"). By accessing or using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms of Use.

2. Limited License and Access

Subject to your compliance with these Terms, Offline Player grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the Service on a mobile device that you own or control and to run such copy of the Service solely for your own personal, non-commercial purposes.

• Volume Boost: The Volume Boost feature is provided to enhance sound clarity. You agree to use this feature responsibly and acknowledge that excessive volume levels may cause damage to your hearing or speakers, for which Offline Player is not liable.

3. User Content and Playlists

You retain ownership of any data, text, files, information, playlists, and other material that you submit or create through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the User Content solely for the purpose of operating and providing the Service to you.

4. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to:

• Systematically retrieving data or other content from the Service to create or compile a collection, compilation, database, or directory.
• Making any unauthorized use of the Service, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email.
• Using the Service to download or distribute copyrighted material in violation of applicable law.
• Attempting to bypass any measures of the Service designed to prevent or restrict access to the Service, or any portion of the Service.

5. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. Offline Player EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

IN NO EVENT SHALL Offline Player, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OR INABILITY TO USE THE SERVICE; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Jurisdiction of Company], without regard to its conflict of law provisions.
